Callahan questioned the <br />circumstances that could result if the Council denies the <br />application. Callahan recollected that the jjj® <br />Planning Commission recommendation was due to the date of the <br />real estate closing on the property. <br />Mr. Ritchie added that the date for Dr. Roshar to begin her <br />practice was also a pertinent factor in the Planning Commission <br />recommendation. <br />Councilmember Nettles said that any risks would fall on the <br />buyer of the property. <br />It was moved by Councilmember Nettles* seconded by <br />Councilmember Peterson* to adopt Resolution #2739* approving the <br />conditional use permit for Robert Ritchie. Gaffron said that the <br />reviewed this proposal and recommends approval of the vacation <br />and rededications. In addition, the applicants are requesting <br />approval of a side setback variance for a deck and appeal of an <br />administrative decision denying construction of a fence in the <br />right-of-way of Farview Lane. <br />Q^ffron briefly explained the request for a side setback
