The City Council has considered this application including the findings and recommendations of the Planning Commission, reports by City staff, comments by the applicant and the effect of the proposed variance on the health, safety and welfare of the community.5. The City Council finds that the conditions existing on this property are peculiar to it and do not apply generally to other property in this zoning district; that granting the <br />variance would not adversely affect traffic conditions, <br />light, air nor pose a fire hazard or other danger to <br />neighboring property; wouId not merely serve as a <br />convenience to the applicant, but is necessary to alleviate <br />a demonstrable hardship or difficulty; is necessary to <br />preserve a substantial property right of the applicant; and <br />would be in keeping with the spirit and intent of the Zoning <br />Code and Comprehensive Plan of the City. <br />CONCLUSIONS, ORDER AND CONDITIONS <br />Based upon one or more of the findings noted above, the <br />Orono City Council hereby grants a variance to Municipal Zoning <br />Code Section 10.22, Subdivision 1 to permit the total replacement <br />of the foundation under the existing residence, subject to the <br />following conditions: <br />1. All conditions of resolution #2694 that granted approval <br />of the variances to the average setback line and excessive <br />hardcover within the 75-250' setback area for the addition <br />to the rear of the existing residence remain in effect for <br />this current variance review and they are as follows: <br />A) Hardcover on the property shall be allowed as <br />follows: <br />0-75' Zone = 0 s.f. <br />75-250' Zone (area « 14,801 s.f.): <br />House + Addition <br />Garage <br />Dog Run <br />Deck/Stairs/Stoops/ <br />Landscaping/Etc. <br />Driveway <br />TOTAL <br />Page 2 of 6 <br />1,059 s.f. <br />550 s.f. <br />230 s.f. <br />622 s.f. <br />2,238 s.f. <br />4,699 s.f.or 31.7% <br />*-u- ■_ rt--.’>.-_l J
