Wetland buffers shall be established via easement and covenants to be filed in the <br /> chain of title of the property. Buffers shall be maintained in the areas shown on <br /> Exhibit D; all landscaping shall be planted and maintained per the planting plan <br /> attached to this Resolution as Exhibit F as annotated by Staff. <br /> 4. Applicant shall not place any plastic or fabric liner material under any landscaping on <br /> the property to ensure their permeability as non-hardcover surfaces. <br /> 5. Council approval is based on the grading and floodplain mitigation plan submitted by <br /> the Applicant and annotated by City staff, attached to this Resolution as Exhibits C <br /> and E. Any amendments to these plans may require further Planning Commission <br /> and City Council review. <br /> 6. MCWD permit for floodplain alteration/mitigation shall be submitted to the City prior to <br /> the issuance of a building permit. <br /> 7. The home plans submitted are for the purpose of hardcover review. The construction <br /> plans and survey submitted for building permit will be reviewed for conformance with <br /> Orono's building height and number of stories calculation. <br /> 8. Authorities granted by this resolution run with the Property not with the Applicant, but <br /> are permissive only and must be exercised by obtaining a building permit for the new <br /> construction and commencing construction of said project. A framing inspection must <br /> be completed within one year of the date of Council approval, or the variances and <br /> conditional use permit will expire on that date (April 9, 2013). <br /> 9. Violation of or non-compliance with any of the terms and conditions of this resolution <br /> shall constitute a violation of the zoning code, shall automatically terminate any <br /> authority granted herein, and shall be punishable as a misdemeanor. <br /> 10. The undersigned Owner and Applicant have read, understood and hereby agree to <br /> the terms of this resolution and on behalf of their heirs, successors and assigns, <br /> hereby agree to the recording of this resolution in the chain of title of the property. <br /> Page 6 of 7 <br />
