� O� <br /> O �� O CITY of ORONO <br /> �� - <br /> � ` ,-� --:; D+ RESOLUTION OF THE CITY COUNCIL <br /> � ��F No. 61a2 <br /> t�kESH�g'� <br /> width are normally required; and a variance to Section 78-350(B) to allow a 10-foot side street <br /> setback from the unimproved ROW of Ivy Lane where a 15-foot setback is normally required; <br /> and Section 78-1279 to allow an average lakeshore setback encroachment for portions of the <br /> proposed 10'x 10' covered lakeside deck; and Section 78-1288 to allow 46% hardcover within <br /> the 75'-250' zone where 25% is normally allowed in conjunction with the construction of a new <br /> home, subject to the following conditions: <br /> 1. Council approval is based on the survey, building plans and landscape plan submitted by <br /> the Applicants and annotated by City staff, attached to this Resolution as Exhibits A, B <br /> and C. Any amendments to the plans which are not in conformity with City codes will <br /> require further Planning Commission and City Council review. <br /> 2. Hardcover shall not increase above the approved levels as follows: 0% hardcover within <br /> the 0-75' zone; and 3,549 square feet(46%) of hardcover within the 75' to 250' zone. <br /> 3. Applicants must provide a copy of the recorded deed reflecting combination of the two <br /> tax parcels prior to issuance of a building permit for the proposed residence. <br /> 4. The Applicants shall remove all encroachments from the ROW of Ivy Lane and restore <br /> the grades according to the approved plans and the City Engineer's recommendations <br /> prior the C.O. for the proposed residence. <br /> 5. The Applicants shall implement the approved landscape plan attached as Resolution <br /> Exhibit C prior to the issuance of a C.O. for the proposed residence. <br /> 6. The Applicants' exterior lighting shall be in conformance with the City's lighting <br /> standards; downward-directed exterior lighting fixtures are preferred. <br /> 7. The Applicant's building permit survey and plans shall address the city engineer's <br /> comments and recommendations. <br /> 8. The home plans submitted are for the purpose of hardcover review. The construction <br /> plans and survey submitted for building permit will be reviewed for conformance with <br /> Orono's building height and number of stories calculation. <br /> 9. Authorities granted by this resolution run with the Property not with the Applicants, but <br /> are permissive only and must be exercised by obtaining a building permit for the new <br /> construction and commencing construction of said project.
