� o� <br /> O �, � O CITY of ORONO <br /> ��,- <br /> � ' -�' � RESOLUTION OF THE CITY COUNCIL <br /> . � <br /> �'�� :�� �� N o. 6 ) 1 1 <br /> �kEsH�g'� <br /> A RESOLUTION GRANTING A VARIANCE <br /> TO MUNICIPAL ZONING CODE <br /> SECTION 78-420 (B) <br /> FILE NO. 11-3527 <br /> WHEREAS, Jason Smith and Jody Smith, husband and wife (hereinafter "the <br /> Applicants") are the owners of the property located at 2690 Rainey Road witl�in the City of <br /> Orono (hereinafter the"City") and legally described as follows: <br /> Lot 3, Block 2, Trees to Be, together with the appurtenant easement(s) contained <br /> in Document No. 5441457, according to the recorded plat thereof on fle and of <br /> record in the office of the County Recorder Hennepin County, Minnesota <br /> (hereinafter the"Property"); and <br /> WHEREAS, the Applicants have made application to the City of Orono for a <br /> variance to Orono Municipal Zoning Code Section 78-20 (B) to allow construction of an <br /> attached garage addition 38 feet from the side, street lot line where a 50 foot setback is required. <br /> NOW, THEREFORE BE IT RESOLVED by the City Council of Orono, <br /> Minnesota: <br /> FINDINGS <br /> 1. This application was reviewed as Zoning File 11-3527. <br /> 2. The property is located in the RR-1 B, Single Family Rural Residential Zoning <br /> District which requires a minimum lot area of 2.0 acre and a minimum lot width <br /> of 200'. <br /> 3. The Planning Commission reviewed this application at a public hearing held on <br /> October 17, 2011 and with a vote of 4 to 1 recommended denial of the variance as <br /> requested. <br /> 4. On November 14, 2011 and February 13, 2012 the Orono City Council reviewed <br /> this application and voted to approve the variance to allow a 40 foot setback from <br /> the side, street lot line based on the following findings: <br /> Page 1 of 4 <br />
