CITY OF ORONO RESOLUTION OF THE CITY COUNCIL NO. 7496 5 B20. Designed to take into account the natural, scenic, and historic features of the area and to minimize environmental impact; The applicant will obtain all necessary permits from outside agencies such as MCWD and NPDES permit. The applicant is working within their private land and is proposing to restore the disturbed area with natural plantings and vegetation. This criterion is met. B21. All exterior lighting shall be so directed so as not to cast glare toward or onto the public right-of-way or neighboring residential uses or districts; This criterion is met; and B22. Not detrimental to the public health, public safety, or general welfare. This criterion is met. CONCLUSIONS, ORDER AND CONDITIONS: Based upon one or more of the above findings, the Orono City Council hereby grants a vacation of an existing drainage easement and a n interim use permit pursuant with Orono Municipal Zoning Code Sections 78-916 and 78-1726 to allow approximately a 70,000 sq.ft of disturbance across 3295 and 3345 Fox Street for the removal and newly created stormwater pond, subject to the following conditions: 1. Council approval is based on the entire record and the above Findings. 2. The approved project shall conform to the plans by Moore Engineering submitted by the Applicants and annotated by City staff, attached to this Resolution as Exhibit A. 3. The approved Stormwater Maintenance agreement adopted by the City Council on August 12, 2024. 4. Any amendments to the plans that are not in conformity with City codes may require further Planning Commission and City Council review. 5. The Applicants agree to comply with the permitting requirements of all applicable jurisdictions including the Minnehaha Creek Watershed District. 6.
