Designed to take into account the natural, scenic, and historic features of the <br />area and to minimize environmental impact; The applicant will obtain all <br />necessary permits from outside agencies such as MCWD and NPDES <br />permit. The applicant is working within their private land and is proposing <br />to restore the disturbed area with natural plantings and vegetation. This <br />criterion is met. <br />B21. All exterior lighting shall be so directed so as not to cast glare toward or onto <br />the public right-of-way or neighboring residential uses or districts; This criterion <br />is met; and <br />B22. Not detrimental to the public health, public safety, or general welfare. This <br />criterion is met. <br /> <br />CONCLUSIONS, ORDER AND CONDITIONS: <br /> <br /> Based upon one or more of the above findings, the Orono City Council hereby <br />grants a vacation of an existing drainage easement and a n interim use permit pursuant <br />with Orono Municipal Zoning Code Sections 78-916 and 78-1726 to allow approximately <br />a 70,000 sq.ft of disturbance across 3295 and 3345 Fox Street for the removal and <br />newly created stormwater pond, subject to the following conditions: <br /> <br />1. Council approval is based on the entire record and the above Findings. <br /> <br />2. The approved project shall conform to the plans by Moore Engineering submitted <br />by the Applicants and annotated by City staff, attached to this Resolution as <br />Exhibit A. <br /> <br />3. The approved Stormwater Maintenance agreement adopted by the City Council <br />on August 12, 2024. <br /> <br />4. Any amendments to the plans that are not in conformity with City codes may <br />require further Planning Commission and City Council review. <br /> <br />5. The Applicants agree to comply with the permitting requirements of all applicable <br />jurisdictions including the Minnehaha Creek Watershed District. <br /> <br />6. Authorities granted by this resolution run with the Property not with the <br />Applicants, but are permissive only and must be exercised by commencing said <br />99
