Date: August 12, 2024 Item: 13 <br />Presenter: Laura Oakden, Community Development Director <br />Section: Consent Agenda <br /> <br />Title: #LA24-000027, 3295 and 3345 Fox Street, Easement Vacation and Interim <br />Use Permit, Resolution- 7496 <br /> <br /> <br />1.Purpose: <br />This application is regarding vacation and re-dedication of drainage easements impacting 3295 <br />and 3345 Fox Street. <br />2.MN§15.99 Application Deadline: <br />The application was received and was considered to be complete on June 12, 2024. Additionally, <br />the 60-Day review period was extended and now expires on October 10, 2024. <br />3.Background: <br />The applicant represents the owner of both properties and is requesting approvals in order to move <br />the existing stormwater pond from one property to the other. The Fullerton Estates plat required <br />creation of a stormwater pond and drainage easement on the 3295 Fox Street property. The <br />applicant proposes to vacate the current drainage easement and fill in the existing stormwater <br />pond; a new, replacement pond is proposed on the 3345 Fox Street property. A replacement <br />drainage easement will be dedicated over the new pond/drainage area to address stormwater within <br />the Fullerton Estates plat. <br /> <br />The project requires an interim use permit (IUP) due to the size of the disturbance. The total <br />disturbed area is 1.59 acres (69,2602 sq. ft.). The applicant would like to begin this project in the <br />fall of 2024 and will restore the area with natural plantings in 2025. <br />4.Planning Commission Vote and Comment: <br />On July 15 the Planning Commission held a public hearing. Following the public hearing the <br />Planning Commission voted unanimously to support application.
