This application was reviewed as Zoning File number 13-3600. <br /> 2. The Property is located in the LR-1 B One Family Lakeshore Residential Zoning <br /> District which requires a minimum lot area of 1.0 acre and a minimum lot width of <br /> 140'. <br /> 3. The Planning Commission reviewed this application at a public hearing held on <br /> April 15, 2013 and voted 2 for and 3 against on a motion to approve the average <br /> lakeshore setback variance and CUP; this motion failed. <br /> 4. The Planning Commission voted 3 for and 2 against on a second motion to <br /> approve the CUP and deny the average lakeshore setback variance based on <br /> the following findings: <br /> a. The Property contains 51,650 square feet in area and has a defined width of <br /> 84-feet at the lake and 88-feet at the 75-foot setback. <br /> b. The home on the Property has existed since the early 1950s. <br /> c. The Planning Commission finds a new home can be constructed to meet the <br /> required average lakeshore setback. <br /> d. If no other variances were requested a lot width variance would not be <br /> necessary per City Code 78-72(c). <br /> 5. The City Council reviewed the application at the April 22, 2013 and May 13, 2013 <br /> meetings and finds that the following factors support the granting of the <br /> requested variances and CUP: <br /> a. The adjacent home at 3020 North Shore Drive is located approximately 180 <br /> feet from the lake, and the home at 3060 North Shore Drive is located <br /> approximately 70 feet from the lake resulting in an average lakeshore setback <br /> line at approximately a 45 degree angle across the Applicant's property. <br /> b. The home at 3020 North Shore Drive is situated with views facing Norenberg <br /> Park and Maxwell Bay to the east and north. The home is not oriented to <br /> have views of the lake across the Applicant's property. <br /> c. Both adjacent neighbors (at 3020 North Shore Drive and 3060 North Shore <br /> Drive) have submitted letters of support for the application including the <br /> average lakeshore setback variance as requested. The proposed location of <br /> the proposed home is the preferred location for both neighbors. <br /> Page 2 of 5 <br />
