. <br /> � .� 0,�. <br /> O , O CITY of ORONO <br /> � 5 - <br /> �-3 ' � RESOLUTION OF TJi��IT�Y COUNCIL <br /> '� 5�� ' o <br /> � �,'�' NO. <br /> ��kESH�4� <br /> A RESOLUTION GRANTING <br /> A CONDITIONAL USE PERMIT <br /> FOR WETLAND ALTERATION <br /> PURSUANT TO ORONO MUNICIPAL CODE <br /> SECTION 78-1609 <br /> FILE NO. 12-3585 <br /> WHEREAS, Spring Hill Golf Club, a Minnesota nonprofit corporation <br /> (hereinafter the "Owner") is the owner of the property located at 1050 Tamarack Road within <br /> the City of Orono (hereinafter "City") and legally described as: Lot 1 Block 1, Spring Hill Golf <br /> Club, Hennepin County, Minnesota, Except That Embraced Within the South 1/2 Of The <br /> Northeast 1/4 Of Section 26 Township 118, Range 23, Hennepin County, Minnesota <br /> (hereinafter"the Property"); and <br /> WHEREAS, Tim Johnson (hereinafter the "Applicant") on behalf of the Owner <br /> has made an application to the City pursuant to Orono Municipal Code Section 78-1609 for a <br /> conditional use permit for wetland alteration (hereinafter the "CUP") in order to fill in portions of <br /> the wetland adjacent to the 13th hole also identified as DNR Public Water Wetland #837W <br /> (hereinafter the "Wetland"); <br /> WHEREAS, the Applicant proposes to mitigate for the impacts to the Wetland <br /> off-site via the purchase of banked credits as governed by the Minnehaha Creek Watershed <br /> District (hereinafter the "MCWD"); and <br /> WHEREAS, after due published notice and mailed notice in accordance with <br /> Minnesota Statutes and the Orono, Minnesota, City Code, the Orono Planning Commission held <br /> a public hearing on March 18, 2013 at which times all persons desiring to be heard concerning <br /> this application were given the opportunity to speak thereon. <br /> NOW, THEREFORE BE IT RESOLVED by the City Council of Orono, <br /> Minnesota: <br /> FINDINGS <br /> 1. This application was reviewed as Zoning File 12-3585. <br /> 2. The Property is located in the RR-1 B One Family Rural Residential Zoning <br /> District which requires a minimum lot area of 2.0 acres and a minimum lot width <br /> of 200'. <br /> Page 1 of 5 <br />
