� o� <br /> O �,: O CITY of ORONO <br /> ��,. <br /> ��r��� <br /> � }� ��t � ��� <br /> �� ` � RESOLUTION OF THE CITY COUNCIL <br /> '� � �� :�_ �� 6 3 9 � <br /> �� y' ° �G'�' NO. <br /> �k'ESH�4 <br /> WHEREAS, after due published notice and mailed notice in accordance with <br /> Minnesota Statutes and the Orono, Minnesota, City Code, a public hearing was held by the <br /> Orono Planning Commission on March 17, 2014 at which times all persons desiring to be heard <br /> concerning this application were given the opportunity to speak thereon. <br /> NOW, THEREFORE BE IT RESOLVED by the City Council of Orono, <br /> Minnesota: <br /> FINDINGS <br /> 1. This application was reviewed as Zoning File number 14-3656. <br /> 2. The Property is located in the LR-1 B One Family Lakeshore Residential Zoning <br /> District which requires a minimum lot area of 1.0 acre and a minimum lot width of <br /> 140'. <br /> 3. The Planning Commission reviewed this application at a public hearing held on <br /> March 17, 2014 and voted 6 for and 0 on a motion to approve the CUP and the <br /> hardcover variance based on the following findings of fact: <br /> a. The Property contains 32,622 square feet (0.75 acres) in area. <br /> b. The Property has lakeshore on two sides therefore there are two separate 0- <br /> 75' zones. The property has 153' in width at the southern location of the <br /> Ordinary High Water Level (hereinafter the "OHWL") and 184' in width at the <br /> southern 75' from the OHWL; and has 244' in width at the northern OHWL <br /> and 209' in width at the northern 75' from the OHWL. <br /> c. The Applicant's proposed landscape plan has been designed in a way which <br /> offers screening of the improvements with a natural vegetation as viewed <br /> from the lake and from neighboring properties. <br /> d. With a total of 20.54% overall hardcover, the Property will conform to the 25% <br /> hardcover limitations of a Tier 1 lot. <br /> e. Minnesota State Statute 462.357 permits an existing non-conforming <br /> structure to be reconstructed in-kind. The construction of the paver sidewalk <br /> and the conversion of the west porch to an elevated patio and pavers appear <br /> to be in-kind replacements and can be approved administratively. <br /> f. After-the-fact hardcover and lake setback variances are required because <br /> discrepancies between the 2007 and current surveys, and the available <br /> information in applicant's submittals, testimony and City records, are <br /> Page2of5 <br />
