Feldmann and Donelie L. Feldmann, a married couple <br /> (hereinafter "the Applicants") are the owners of the property located at 805 Forest Arms Lane <br /> within the City of Orono (hereinafter the "City") and legally described as Lot 1, Block 2, Forest .`TI5 <br /> Arms, Hennepin County, Minnesota (hereinafter the "Property"); and <br /> WHEREAS, the Applicants have made application to the City of Orono for a <br /> variance to Orono Municipal Zoning Code Section 78-1279(6) to allow construction of a new 20' <br /> x 40' in-ground swimming pool, patio and retaining walls ahead of the average lakeshore <br /> setback on the Property; and <br /> WHEREAS, the Applicants have made application to the City of Orono for a <br /> variance to Orono Municipal Zoning Code Section 78-1605 to allow construction of one retaining <br /> wall within the 50-foot wetland buffer and two retaining walls within the 10-foot setback from the <br /> buffer; and <br /> WHEREAS, after due published notice and mailed notice in accordance with <br /> Minnesota Statutes and the Orono, Minnesota, City Code, the Orono Planning Commission held <br /> a public hearing on March 17, 2014 at which times all persons desiring to be heard concerning <br /> this application were given the opportunity to speak thereon. <br /> NOW, THEREFORE BE IT RESOLVED by the City Council of Orono, <br /> Minnesota: <br /> FINDINGS <br /> 1 This application was reviewed as Zoning File number 14-3655. <br /> 2. The Property is located in the LR-1B One Family Lakeshore Residential Zoning <br /> District which requires a minimum lot area of 1.0 acre and a minimum lot width of <br /> 140'. <br /> 3. The Planning Commission reviewed this application at a public hearing held on <br /> March 17, 2014 and voted 6 for and 0 against on a motion to recommend <br /> approval of the average lakeshore setback variance based on the following <br /> findings: <br /> Page 1 of 5 <br />
