� o� <br /> O �a O CITY of ORONO <br /> �;iz _ <br /> � � ' � RESOLUTION OF�HE �I�COUNCIL <br /> "�,+1 � ,��":: <br /> �L ��� No. 3 <br /> �kESH�g' <br /> A RESOLUTION <br /> GRANTING VARIANCES FROM <br /> MUNICIPAL ZONING CODE <br /> SECTION 78-1405 <br /> FILE NO. 14-3648 <br /> WHEREAS, Walter Richard McCarthy Jr., a single person, is the owner <br /> (hereinafter "the Owner") of the property located at 550 Oxford Road within the City of Orono <br /> (hereinafter the "City") and legally described as: Lot 1, Block 1, Fox Hollow, Hennepin <br /> County Minnesota (hereinafter the "Property"); and <br /> WHEREAS, the Owner has made application to the City of Orono for a variance <br /> from Orono Municipal Zoning Code Section 78-1405 to allow construction of a fence 8 feet in <br /> height (hereinafter the "Screening Fence") where 6 feet is the maximum fence height; and <br /> WHEREAS, after due published notice and mailed notice in accordance <br /> with Minnesota Statutes and the Orono, Minnesota, City Code, a public hearing was held by the <br /> Orono Planning Commission on February 18, 2014 at which times all persons desiring to be <br /> heard concerning this application were given the opportunity to speak thereon. <br /> NOW, THEREFORE BE IT RESOLVED by the City Council of Orono, <br /> Minnesota: <br /> FINDINGS <br /> 1. This application was reviewed as Zoning File number 14-3648. <br /> 2. The Property is located in the LR-1A One Family Lakeshore Residential Zoning <br /> District which requires a minimum lot area of 2.0 acres and a minimum lot width <br /> of 200'. <br /> 3. The Planning Commission reviewed this application at a public hearing held on <br /> February 18, 2014 and voted 5 in favor and 0 opposed on a motion to approve <br /> the fence height variance. The Planning Commission finds that the following <br /> factors support the granting of the requested variances: <br /> a. The Property contains 87,090 square feet in area and conforms to the 2 acre <br /> minimum lot size of the LR-1A district. <br /> b. The Owner has proposed an 8-foot high, solid panel PVC privacy fence. <br /> Page 1 of 4 <br />
