� � o� <br /> � <br /> O CITY of ORONO <br /> �_. <br /> ?�t � <br /> � � ��' =' � RESOLUTION OF T��IjY COUNCIL <br /> '� ��.�, � 0 4 <br /> � G NO. <br /> ��kESH�g'� <br /> A RESOLUTION APPROVING A <br /> CONDITIONAL USE PERMIT FOR <br /> A COLUMBARIUM WALL, MEMORIAL LANDSCAPE WALL, <br /> AND OPEN GAZEBO STRUCTURE <br /> PURSUANT TO ORONO CODE SECTION 78-418 <br /> FILE NO. 13-3641 <br /> WHEREAS, Jerilyn Lowe (hereinafter the "Applicant") has made an application <br /> on behalf of Trinity Lutheran Church, the owner (hereinafter the "Owner") of property located at <br /> 2060 Sixth Avenue North within the City of Orono (hereinafter the "City") and legally described <br /> as follows: <br /> See Attached Exhibit A (hereinafter"the Property"); and <br /> WHEREAS, the City of Orono is a municipal corporation organized and existing <br /> under the laws of the State of Minnesota; and <br /> WHEREAS, pursuant to State Statutes 412 et. seq. and 462 et. seq., the City <br /> Council of the City of Orono has adopted zoning regulation for the protection of the public <br /> health, safety and general welfare; and <br /> WHEREAS, the Property contains an existing church and is located in the RR-1 B <br /> one family rural residential district. A church is an allowed use within residential districts by <br /> conditional use permit; and <br /> WHEREAS, the church on the Property has an existing conditional use permit; <br /> and <br /> WHEREAS, on October 23, 2013, the Applicant made an application requesting <br /> a conditional use permit to permit decorative walls and an open sided gazebo structure to be <br /> constructed as part of a memorial garden on the Property pursuant to City Code Section 78-418 <br /> (4); and <br /> WHEREAS, on October 23, 2013, the Applicant also made an application <br /> requesting a conditional use permit for construction of an above-grade columbarium pursuant to <br /> City Code section 78-418(14); and <br /> WHEREAS, after due published and mailed notice in accordance with Minnesota <br /> Statutes 462.3595 et. seq. and the City of Orono Zoning Codes, on November 18, 2013, the <br /> Orono Planning Commission held a public hearing for the application at which time all persons <br /> desiring to be heard concerning the application were given the opportunity to speak thereon. <br /> Page 1 of 4 <br />
