The Planning <br />Commission advised that the vacated right-of-wai would revert to <br />the original underlying fee owner and that it would be the <br />responsibility of the applicants to provide this confirmation <br />prior to scheduling before the Council. Normally the City would <br />have no interest in the resolve of underlying fe*» ownership. The <br />City is only concerned as to the fee ownership as it relates to <br />the granting of future drainage and utility easements. <br />Please refer to Exhibits K through O. Applicants' surveyor <br />has provided confirmation confirming underlying fee ownership. <br />The vacated right-of-way shall revert to the property owners to <br />the east (Brown & Gibbs). The City will ask for drainage and <br />utility easements along the west 10' of the vacated right-of-way. <br />The City has received no further comment from the Knoxes on this <br />matter since receiving the surveyor's information. <br />In response to a request of the Knoxes (property owners to <br />immediate west) City will not vacate the most southern 15' of the <br />right-of-way providing access to the southern portion of their <br />property via dedicated right-of-way. <br />The Planning Commission recommended unanimous approval of <br />the vacation application and amended the original request to <br />exclude the southern 15' of Clara Avenue. The enclosed <br />resolution approving the vacation has been drafted per the <br />Planning Commission's recommendation.
