7'. <br />i: <br />t-ir <br />r'- <br />Iv: <br />A RESOLUTION GRANTING <br />A VARIANCB TO <br />MUNICIPAL X0HIN6 CODE <br />SECTION 10.03, SUBDIVISION 5 (B) <br />FILE #1701 <br />NBBRBAS, Phyllis B. Sprague (hereinafter "the applicant") <br />has an interest in the property located at 3340 North Shore Drive <br />vithin the City of Orono (hereinafter "City") and legally described as <br />follows: <br />Lot 8, "Lydiard's ParJc", Hennepin County, Minnesota <br />(hereinafter "the property"); and <br />NHBKEAS, the applicant has applied to the City for a <br />variance to Municipal Zoning Code Section 10.03, Subdivision 5 (E) to <br />permit an accessory residential use of a B-2 zoned property. The <br />residential use of the property ceased sometime in 1985. The non <br />conforming use code would require that all use of this property <br />conform to current B-2 standards as residential use had ceased more <br />than twelve months ago. <br />Minnesota: <br />HOW, TBBREPORB, BE IT RESOLVED by the City Council of Orono, <br />FINDINGS <br />1. <br />2. <br />This application was reviewed as Zoning File #1701. <br />The property is located in the B-2 Lalceshore Commercial <br />Zoning District requiring 2 acres in area. The property has <br />approximately 11,050 s.f. or .25 acres. <br />3.The Orono Planning Commission reviewed this application on <br />November 18, 1991 and recommended unanimous approval of the <br />proposed variance based upon the following findings: <br />The existing structure and property will be accessory <br />to the principal residential use on applicant's <br />adjacent homestead property. <br />The legal combination of the property will bring the <br />property closer to the area conformance of the B-2 <br />zone. <br />Page 1 of 5 <br />I Vt J
