In <br />addition, the creek from Long Lake is a DNR protected watercourse. <br />Any activity below the ordinary high water (OHW) elevation, which <br />alters the course, current or cross-section of protected waters or <br />wetlands, is under the jurisdiction of the DNR and may require a DNR <br />protected waters permit. It also appears that there are other <br />wetlands on the site that would be subject to regulation by the U.S. <br />Corps of Engineers (cor*’act Joe Yanta at 220-0362) and the city. <br />The OHW for the creek is defined as the "top of the bank. No <br />official OHW has been established for wetland 27-836W. Please <br />contact this office if there is any question about whether proposed <br />activities will be within protected wetland 27-836W and we can make <br />arrangement to estimate or officially determine, if necessary, the <br />OHW. <br />Filling below the OHW (of DNR protected wetlands/waters) for upland <br />development is prohibited. Filling below the OHW for public <br />roadways can be permitted only if: 1) the public need rules out the <br />no-build alternative, and 2) the alignment is the least impact <br />alternative. It appears that the road proposed on the east side of <br />the wetland will need to^elocated in order to avoid filling in <br />wetland 27-836W. <br />A significant portion of the site is within the 100 : -ar floodplain <br />district (a copy of the appropriate portion of the Flood Insurance <br />Rate Map is enclosed). Any activity within the floodplain would <br />have to be consistent with the floodplain regulations of both the <br />City of Orono (contact Jeanne Mabusth at 473-7357) and Minnehaha <br />Creek Watershed District (contact Ron Quanbeck at 473-4224). For <br />example, the lowest floors of the structures would have to meet the <br />minimum flood protection elevation, and compensatory storage may be <br />required for any filling within the floodplain. <br />2. <br />3. <br />AN EQUAL opportunity EMPLOYER
