The Planning Commission finds a new home can be constructed to meet the <br /> required average lakeshore setback. <br /> c. The Property has a unique shape and a large 0-75' area which partially <br /> functions as though it is a peninsula. <br /> d. Both adjacent neighbors (at 2691 Caroline Avenue and 2696 Caroline <br /> Avenue) have submitted letters of support for the application including the <br /> average lakeshore setback variance as requested. <br /> e. The proposed elevated patio and associated grading will meet the 75-foot <br /> lake setback. <br /> f. The Property will conform to the hardcover limitations of Tier 1. <br /> g. The Applicants' proposed elevated patio will not alter the essential character <br /> of the neighborhood and will result in minimal or no negative impact on <br /> adjacent properties. <br /> h. The Applicants' proposal to remove the existing above grade deck and move <br /> the outdoor living space to the southeast side of the Property will improve the <br /> potential lake views enjoyed from the home at 2691 Caroline Avenue. <br /> i. The existing lake views enjoyed from the property at 2696 Caroline Avenue <br /> will not be adversely impacted by the Applicants' proposed patio due to the <br /> elevation difference between the properties and the existing trees on both <br /> properties. <br /> j. The Applicants' request is in harmony with the purpose and intent of the <br /> ordinance. <br /> k. The Applicants have demonstrated that enforcing the provisions of the Zoning <br /> Ordinance deprives the Applicants of the reasonable use of their Property. <br /> l. The Applicants' proposed elevated patio is designed in a way which <br /> minimizes impact of the visual encroachment as opposed to the existing <br /> elevated deck. <br /> m.
