Designed to take into account the natural, scenic, and historic features of the area and to <br />minimize environmental impact; the applicant has opted to install replacement walls <br />using boulder materials and has proposed landscaping that will screen the walls and will <br />be compatible with the character of the improvements within the surrounding area. This <br />criterion has been met. <br />B18. All exterior lighting shall be so directed so as not to cast glare toward or onto the public <br />right-of-way or neighboring residential uses or districts; the lake yard improvements <br />should not result in any lighting or glare being cast off the property toward the public <br />street, the neighbors, or the lake. This criterion has been met; and <br />B19. Not detrimental to the public health, public safety, or general welfare. This is true of the <br />project. <br />CONCLUSIONS, ORDER AND CONDITIONS: <br />Based upon one or more of the above findings, the Orono City Council hereby grants a <br />variance to Orono Municipal Zoning Code Sections 78-196 and 78-1279 to allow construction of <br />retaining walls and a new lake access stair to be supported by retaining walls, subject to the <br />following conditions: <br />C1.Council approval is based on the entire record and the above Findings. <br />C2.The approved project shall conform to the survey by Advance Surveying & Engineering, <br />Co., dated 10/27/2022 and revised on 03/11/2024, the engineered wall design by <br />Criterium-Twin Cities Engineers dated 03/18/2024, and the landscape plan by <br />Landscapes Unlimited submitted by the Applicants and annotated by City staff <br />collectively the "Plans"), attached to this Resolution as Exhibits A, B, & C. <br />C3.Any amendments to the Plans that do not conform to City codes may require further <br />Planning Commission and City Council review. <br />C4.The Owners shall comply with the permitting requirements of the Minnehaha Creek <br />Watershed District. <br />C5.The undersigned Owners agree to the conditions herein. <br />5
