The City Council has considered this application including <br />the findings and recosunendations of the Planning Coininission, <br />reports by City staff# comments by the applicant and the <br />effect of the proposed variance on the health, safety and <br />welfare of the community. <br />7. The City Council finds that the conditions existing on this <br />property are peculiar to it and do not apply generally to <br />other property in this soning district; that granting the <br />variance would not adversely affect traffic conditions# <br />light# air nor pose a fire hazard or other danger to <br />neighboring property; would not merely serve as a <br />convenience to the applicant# but is necessary to alleviate <br />a demonstrable hardship or difficulty; is necessary to <br />preserve a substantial property right of the applicant; and <br />would be in keeping with the spirit and intent of the Zoning <br />Code and Comprehensive Plan of the City. <br />OOSCLOSIOHS# OHDIK AND CONDITIONS <br />Based upon the above findings# the Orono City Council hereby <br />grants variances to Municipal Zoning Code Section 10.22# Subdivision <br />I, taction 10.03# Subdivision 9 (£)# and Section 10.03# Subdivfsion 14 <br />(C) to permit the construction of a 24 ’x32* detached garage located <br />3.3* from the west lot line and 10.5* from the south lot line where <br />normally IS' lot line setbacks would be required# and allowing lot <br />ooTorage to increase to 17.5% where only 15% lot coverage is normally <br />allowed, and allowing 4i.9% hardcover in the 75-250’ tone where only <br />2S% hardcover is normally allowed# subject to the following <br />conditional <br />1. Bardcover in the 75-250* sone is approved at level of 44.9%. <br />All existing and proposed hardcover approved with this <br />variance approval is recorded in the calculation worksheet <br />and diagram enclosed with this resolution as page 3. The <br />current property owner and all future owners of the property <br />ere placed on notice that hardcover shall not be increased <br />above the currently approved level and any proposed <br />iagrovomsnts of the property that would result in additional <br />hardcover in either the 0-75' or 75-250* tone must be <br />approved by the City.
