� o� <br /> O � O CITY of ORONO <br /> ;_ <br /> � ���'� � RESOLUTION OF���I�COUNCIL <br /> G'�' NO. <br /> ���xE O�� <br /> SH <br /> A RESOLUTION REVISING THE <br /> BOULEVARD LANDSCAPE PLAN <br /> FOR THE PLAT OF <br /> BAYSIDE MEADOWS <br /> FILE #13-3630 <br /> WHEREAS, the City of Orono is a municipal corporation organized and existing <br /> under the laws of the State of Minnesota; and <br /> WHEREAS, the City Council of the City of Orono (hereinafter "City Council") has <br /> adopted subdivision and land development regulations for the orderly, economic and safe <br /> development of land within the City; and <br /> WHEREAS, on October 14, 2013 the City Council considered the request by the <br /> developers Ervin Anthony Wachman Jr. and Michelle Marie Wachman, a married couple <br /> (hereinafter the "Owners") to allow a reduction in the number of required boulevard landscape <br /> trees pursuant to the waiver provisions in Orono Municipal Code Section 82-226 (b)(1) for the <br /> property legally described as the plat of Bayside Meadows, Hennepin County, Minnesota <br /> (hereinafter the "Property"); and <br /> WHEREAS, after due published notice and mailed notice in accordance with <br /> Minnesota Statutes and the Orono, Minnesota, City Code, a public hearing was held by the Orono <br /> Planning Commission on September 16, 2013 at which times all persons desiring to be heard <br /> concerning this application were given the opportunity to speak thereon; and <br /> NOW, THEREFORE BE IT RESOLVED by the City Council of Orono, Minnesota: <br /> FINDINGS <br /> 1. This application was reviewed as #13-3630. <br /> 2. The plat of Bayside Meadows was granted final plat approval on June 24, 2013. <br /> 3. The road within the Property results in 2,270 linear feet of frontage requiring 57 trees. <br /> 4. The approved landscape plan for the Property reflects the code-required number and <br /> placement of boulevard trees. <br /> 5. City Code Section 82-226(b)(1) directs developers to plant one shade tree along the new <br /> roadway every 40 feet. <br /> 6. City Code Section 82-226(b)(1) provides the City Council with the authority to waive <br /> landscape requirements as deemed appropriate. <br /> 7. The applicant has provided a revised boulevard landscape plan reflecting a more rural or <br /> � natural placement of 42 boulevard trees. <br /> Page 1 of 2 <br />
