Resolution No. 2960 of the City Council is hereby amended by <br />allowing the construction of the new residence per the site <br />plan attached to this resolution as Exhibit A, allowing a <br />27' east side lot line setback where a 30* side setback is <br />normally required, subject to conditions 1-3 of Resolution <br />Mo. 2960. <br />2. Authorities granted by this resolution run with the property <br />not with the applicants, but are permissive only and must be <br />axercised by application for a building permit within one <br />year of the date of original Council approval of Resolution <br />No. 2960, or this variance will expire on that date (May 13, <br />1992). <br />3. Violation of or non-compliance with any of the terms and <br />conditions of this variance shall constitute a violation of <br />the soning code, shall automatically terminate any authority <br />^]*iinted herein, and shall be punishable as a misdemeanor. <br />4. The undersigned applicants have read, understood and hereby <br />agree to the terms of this resolution and on behalf of <br />himself, his heirs, successors and assigns, hereby agrees to <br />the recording of this resolution in the chain of title of <br />the property. <br />Page 2 of 4
