NARRATIVE <br /> <br />SF Real Estate, LLC, a Minnesota limited liability company, applicant, owns Lots 1 and 2, Block <br />1, Fullerton Estates, City of Orono, County of Hennepin, State of Minnesota (the “Property”). A <br />Drainage Easement is recorded in the Plat of Fullerton Estates. In addition, a Drainage Easement <br />Agreement, dated September 30, 1997, between the then fee owners of the Property, and the City <br />of Orono, was recorded in the office of the Registrar of Titles for Hennepin County, on December <br />11, 1997, as document No. 2868640. <br />The Property is also subject to a Stormwater Facility Maintenance Agreement, dated September <br />30, 1997, between the then fee owner of the Property and the Minnehaha Creek Watershed District, <br />record in the office of the Registrar of Titles for Hennepin County, on December 11, 1997, as <br />document No. 2868641. <br />Applicant has submitted a Permit Application to the Minnehaha Watershed District, Permit <br />Application No. 23-495, requesting permission to relocate the Stormwater Management Facility <br />on the Property. Applicant is seeking to fill in the existing pond on Lot 1, and replace it with rain <br />gardens located on Lot 2. The Permit Application is currently in the public notice period, which <br />expires May 23, 2024, <br />As part of the relocation, Applicant is requesting the existing Drainage Easement in the plat of <br />Fullerton Estates be vacated and replaced with a new Drainage Easement. <br />The applicant has no intention of building any structure on Lot 1, for the foreseeable future. <br />However, MCWD has requested, and the Applicant has submitted to the Watershed District, <br />conceptual future stormwater treatment plans for a future for a future residence. <br />67
