Date: July 15, 2024 Item: 5.3 <br />Presenter: Laura Oakden, Community Development Director <br />Section: Public Hearings <br /> <br />Title: LA24-000027, Bruce Boeder o/b/o SF Real Estate LLC, 3295 and 3345 Fox <br />Street, Easement Vacation and Interim Use Permit (Staff: Laura Oakden) <br /> <br /> <br />1.Purpose: <br />The applicant is requesting approval to relocate a storm pond (including easement vacation and <br />dedication); and an interim use permit to fill the existing pond and regrade the area for a new <br />pond. <br />2.MN§15.99 Application Deadline: <br />The application was made on May 20, 224 and was deemed complete June 12, 2024, the 60 day <br />review period expires August 11, 2024. <br />3.Background: <br />The applicant represents the owner of both properties. The Fullerton Estates plat required creation <br />of a stormwater pond and drainage easement on the 3295 Fox Street property. The applicant <br />proposes to vacate the current drainage easement and fill in the existing stormwater pond; a new, <br />replacement pond is proposed on the 3345 Fox Street property. A replacement drainage easement <br />will be dedicated over the new pond/drainage area to address stormwater within the Fullerton <br />Estates plat. <br /> <br />The project requires an interim use permit (IUP) because of the size of the disturbance. The total <br />disturbed area is 1.59 acres (69,2602 sq.ft). The applicant is looking to begin this project in the <br />fall of 2024 and will restore the area with natural plantings in 2025. <br /> <br />4.Staff Recommendation: <br />If the Commission finds the proposed changes to the drainage easement and regrading for a new <br />stormwater pond meet the stormwater protection goals for the Fullerton Estate development, a <br />motion for approval should be proposed.
