The <br />subject property is substandard in size and width. The lot is 0.29 acres when the LR-1A District requires a <br />minimum of 2 acres. The lot is approximately 105 feet in width when 200 feet in width is the minimum. <br />The proposed deck is attached to the home and therefore must abide by the principal structure setbacks <br />of 50 feet from the rear property line and 30 feet from the side property line. The existing home on the <br />property is nonconforming and approximately 42 feet from the rear property line. The construction of any <br />rear deck would require a variance. The proposal meets all other zoning requirements, including <br />hardcover. <br /> <br />Practical Difficulties Analysis <br />Applicant Submittal Information: The applicant has identified the subject property’s substandard size and <br />width as practical difficulties. The applicant has stated the deck will provide much needed outdoor <br />gathering space for the homeowner. <br /> <br />Planning Staff Practical Difficulty Analysis: Staff agrees with the applicant’s assessment. The subject <br />property is substandard and without variances, a rear deck could not be constructed.
