All of that plastic in <br />the 0-75' zone is proposed to be removed. The other 0-75' <br />changes amount to replacing a portion of the removed brick <br />patio with wooden deck. <br />J^ipllcant's Statement of Bardship <br />Please read the notes on the submitted application form. <br />DlSCDSSiOO <br />It can certainly be argued that since this residence was <br />constructed under the current zoning code, there should be no <br />hardcover in the 0-75' zone, oth-r than the stairway system near <br />the shoreline to provide lake access. The poor condition of the <br />existing deck structures indicate they have been in place for <br />quite some time, certainly proceeding the current or immediate <br />past owners. <br />While the 0-75' hardcover is proposed to be reduced by half, <br />the net effect of the application is that the "constructed" <br />portion of 0-75' hardcover will increase from a 315 s.f. deck to <br />a 647 s.f. deck. The stairway proposed adjacent to the existing <br />pool and corner deck provides access to the lower level, but <br />encroaches into the 26' setback from the wetland as defined by <br />the 930* contour. There also will be an encroachment across the <br />platted drainage easement boundary, which is not concurrent with <br />the actual edge of the wetland. Technically City approval is <br />required for encroachment into the easement.
