r <br />4. <br />5. <br />A) The property currently has 3 driveways. The most <br />western drive is a s*'ared drive with the <br />neighboring property on the west side and is the <br />only access to the property to the west. <br />B) Based on the location of mature trees in the <br />street yard and the drop in elevation to the east <br />side of home of 8', a limited turnaround portion <br />of the middle drive has been retained to provide <br />safe access from site. <br />C) Applicant has reduced hardcover within the 250- <br />500' setback area from 39.6% to 21.3%. <br />D) Applicant has reduced hardcover within the 75-250' <br />setback area from 8,380 s.f. or 50.7% to 5,534 <br />s.f. or 33.4%. <br />E) The property contains a concrete spillway that <br />serves a watershed located on the north and south <br />side of Shadywood Road. <br />The City Council finds that the conditions existing on <br />this property are peculiar to it and do not apply <br />generally to other property in this zoning district; <br />that granting the variance would not adversely affect <br />traffic conditions, light, air nor pose a fire hazard <br />or other danger to neighboring property; would not <br />merely serve as a convenience to the applicant, but is <br />neces iry to alleviate a demonstrable hardship or <br />difficulty; is necessary to preserve a substantial <br />property right of the applicant; and would be in <br />keeping with the spirit and intent of the Zoning Code <br />and Comprehensive Plan of the City. <br />The City Council has considered this application <br />including the findings and recommendations of the <br />Planning Commission, reports by City staff, comments by <br />the applicant and the effect of the after-the-fact <br />variance on the health, safety and welfare of the <br />community. <br />Page 2 of 6
