The property was <br />not really appropriate for a single family residential use and <br />h^ped that a more compatible use be inrtalled on the property. <br />Members noted the uncertainty of the 394 corridor location and <br />the impact on this property because 2 of the proposed corridors <br />will have a major impact on this property. It was clear tha^ <br />although the split vote was created by -he more comprehensive <br />aspect of the recommendation, all concurred that the use proposed <br />by Mr. Turner is unacceptable for the residential zoned property. <br />One member noted since the me«*-ting that a displav/showroom/sales <br />use for a plurabing/electrical shop could turn into a future <br />"Hardware Hank" type operation. <br />Options of Action Available to Council <br />A conceptual approval of proposed conditional use permit and <br />variances proposed by applicant pending an opinion from the <br />City Attorney as to the legality of granting variances to the <br />non*~conforming use sections of the Code. Based upon the City <br />Attorney's direction to the Council, applicant would then be <br />required to submit an amended site plan for further review by the <br />Planning Commission, the amended application shall include the <br />following information: <br />1. Amend site plan to reflect actual lot lines relative to <br />Quit Claim Deed of right-of-way to County and provide <br />amended parking plan for 15 stalls. <br />2. Landscape plan? <br />3. Detail on lighting. Locate existing lighting and <br />proposed lighting on site plan. All proposed lighting <br />must be shielded from adjacent residential lot lines <br />and road right-of-ways. <br />4. Detail on signage and location of signs on site plan. <br />5. Refuse cr^ntainer, recycling pad. <br />Denial of the conditonal use permit and variance application <br />of Bruce Turner for a plumbing/electrical display room/store use, <br />a non-conforming commercial use, for the residential property <br />located at 3800 Wayzata Boulevard based on one or more of the <br />following findings: <br />1. The use is Incompatible with the surrounding <br />residetitially developed property.
