SECOND SERIES <br />The Affidavit of Publication was noted. <br />vS, ,\ Callahan axplainsd that tha Council has before them an <br />ordinance establishing a tnoritorlum on land subdivision for <br />properties within 1,000 feet of certain lakes classified within <br />Orono, and along certain waterways and creeks. The mortorlum <br />proposal comes from the Lake Use Committee because the City is <br />required by the bUR to establish new shoreland regulations prior <br />to the end of 1992, If not before. The regulations will extend <br />not only to Lake Minnetonka, but to all lakes and certain <br />tributaries in Orono. He summarized that because the current <br />hardcover ordinances do not generally apply to lakes other than <br />Lake Minnetonka within Orono, these other areas may be greatly <br />affected. The morltorlum Is expected to last up to one year. <br />Merldith Howell, a represontat1ve of a land seller within <br />Orono, asked If the Council Intended to provide a variance <br />procedure within the morltorlum ordinance for properties which <br />clearly would meet the new requirements. <br />Jabbour noted that is why the morltorlum is being Imposed as <br />the Council wishes to forestall any subdivisions to protect <br />future land owners of the possible need for variances on newly <br />subdivided properties. <br />Goetten wanted it to be known that the proposed shoreland <br />regulations do not substantially change the position of Orono's <br />current ordinances. She noted that It should be stated in the <br />newspapers that Orono Is not placing more restrictions on <br />shoreland and that this adoption of the shoreland regulations is <br />required by the DNR. <br />Callahan noted that the major Impact Is not on property <br />surrounding Lake Minnetonka. He also noted that the property <br />being annexed by Long Lake is not covered by this morltorlum. <br />Barrett added the ordinance should be changed under Section <br />5 on Pago 2 to read “and that a failure to grant a variance would <br />cause an undue hardship for the applicant". <br />Callahan explained that by signing the agreement with the <br />DNR to adopt the ordinance by February 1992. the Council may <br />receive money back from the DNR. ho noted that it is the desire <br />of the Council to get this ordinance adopted as soon as possible. <br />It was moved by Goetten. seconded by Butler. to adopt <br />Ordinance #96, Second Series. setting an interim ordinance <br />morltorlum on land subdivisions for certain properties In Orono, <br />for a period not to exceed one year.
