This notification was responded to by Mr. <br />Timothy J. O'Rouke of Dow, Lohnes and Albertson. Mr. O'Rouke's <br />letter requested the Commission to withdraw the letter of April <br />16. All correspondence regarding this issue has been forwarded <br />to the Commission directors for review. <br />On August 20, the Commission met for its regular meeting, and <br />after reviewing the opinion received from its legal counsel <br />(attached) on the noncable-related service charge, the <br />Commission voted 12 to 0, with one abstention, the following <br />motion: <br />Based on the opinion received by the Commission from its legal <br />counsel, Triax is instructed to cease and desist any further <br />assessment of the noncable-related service charge against the <br />auhscribers of the Lake Minnetonka Cable commission and to <br />credit those subscribers who have been assessed this charge <br />thus far. <br />The Commission is available to <br />purs truly. <br />fennifi^ Watts <br />administrator <br />discuss this matter further. <br />CO !LNCCC Member Cities <br />Barb Brancel, LMCCC Chair <br />Tom Creighton, Counsel for the LMCCC <br />Rlc Hanson, Director of Operations, Triax Cablevision <br />enc t
