Based upon the above findings, the Orono Ci y Council hereby grants a variance to Municipal Zoning Code Section 10.03, Subdivision 14 (C) to allow lot coverage of 16.5% where only 15% lot coverage is normally allowed, and grants a variance to Section 10.22r Subdivision 2 to allow 66.2% hardcover in the 250- 500* lone where onl> 30% hardcover is normally allowed, and grants a variance to Section 10.24, Subdivision 5 (B) to allow an addition to be constructed with a side setback of 6.5* where a 10* side setback is normally required, subject to the following conditions: P" . 1. 2. Hardcover in the 250-500' zone is approved at a level of 66.2%. All existing and proposed hardcover approved with this variance approval is recorded in the calculation worksheet and diagram enclosed with this resolution as Page 5. This worksheet and diagram indicate a reduction in the size of proposed decks to yield 66.2% hardcover. Any revisions to the construction plan or site plans which vary from this diagram will joe subject to staff review and approval. The current property owner and all future owners of this property are placed on notice that hardcover shall not be increased above the currently approved level and any proposed improveaents of this property that will result in additioiail hardcover must be approved by the City. Such approval SMiy result in a requirement for concurrent eouivalent or greater removals of existing hardcover. All existing hardcover scheduled for removal as a condition of this resolut on must be removed prior to the footing inspection for new construction. Authorities granted by this resolution run with the property not with the applicant, but are permissi/e only and must be exercised by application for a building permit within one year of the date of Council approval# or this variance will expire on that date (September 9, 1992).
