Ayes 4, <br />nays 0. <br />(#11*) TEMPORARY SIGN ORDINANCE <br />ORDINANCE #97, SECOND SERIES <br />It was moved by Butler, seconded by Goetten, to adopt <br />Ordinance #97. Second Series establishing standards for the use <br />of temporary signs, banners, and advertising balloons. Ayes 4, <br />nays 0. <br />REQUEST FOR ADMINISTRATIVE APPEAL <br />Mabusth explained the Mr. walker currently has an after-the- <br />fact variance application before the City. He is proposing to <br />square off a portion of his house by the addition of a second <br />story and additions to existing deck. She explained the Planning <br />Commission tabled his applies'.on. <br />Walker noted that the deck portion which encroaches within <br />0-75' has been eliminated. <br />Mabusth explained where the second story addition Is <br />proposed, this would be viewed as an Intensification of structure <br />where excessive amounts of hardcover exist. <br />Richard Schleffer, attorney for Mr. Walker, noted that the <br />building permit Is being withheld because of a zoning issue, but <br />felt this should not be done as the structure meets building cod# <br />standards. <br />Jabbour felt that the Council should do whatever can be done <br />to help the applicant. but wanted to know what jssurances does <br />the City have that the requirements be met. <br />Goetten wanted to know what liability the City would have If <br />this were allowed. <br />Schleffer explained the owners have resided there for 20 <br />years. They hired a builder who did some demo work Inside, <br />applied for the permit, and then continued beyond demolition and <br />started building the structure. The applicant is requesting an <br />extension because his mortgage commitment expires October 6th and <br />the builder estimates at least 6 weeks of work. <br />Butler suggested that the permit be Issued conditioned on <br />all documentation for the September Planning Commission meeting <br />be submitted by the deadline date, and if not, a Stop work order <br />be placed on the project.
