Notice of Public Hearing <br />ISSUE - Determine if the Council desires to issue a new license <br />Tor off sale non-intoxicating malt liquor to William Wear at 2160 <br />Wayzata Boulevard. <br />INTRODUCTION - This type of license is allowed in the zoning code <br />ail Ts not otherwise prohibited in the liquor ordinance. <br />Altnough the sale of non-intoxicating malt liquor in a <br />convenience/service station is at times of concern to communites <br />as it relates to the availability of non-intoxicating malt liquor <br />(which can impare those who consume it) to persons operating <br />motor vehicles. <br />In a review in 1987, several surrounding communities stated they <br />do issue licenses to gas station/convenience stores and generally <br />do not consider the close association of gas and 3.2 be>r to be a <br />significant problem. Please note that O'Sullivans in the Navarre <br />area is a convenience/service station licensed to sell non­ <br />intoxicating malt liquor off sale. <br />The background investigation conducted by the police department <br />has not uncovered any disqualifications on the applicant. <br />recommendations - It is recommended tnat the Council conduct the <br />pub 1ic hearing and after consideration of any comments by the <br />public approve the off sale nor-intoxicating malt liquor license <br />for 2160 Wayzata Boulevard as the applicar. currently meets the <br />criteria according to the background invest-igant ion. <br />PROPOSED MOTION - Moved b” , seconded by , to approve an off <br />sale non-intoxicating raal t T i quor 1 i cense”To r William W.
