Normally, a resolution granting <br />preliminary plat approval is effective for one year, after which time <br />it expires. <br />Per the subdi.ision code. Section 11.10, Subdivision 15, "The <br />City may extend the period by agreement with the subdivider and <br />subject to all applicable performance conditions and requirements ' • • • <br />Mr. Butterfield's Inability to continue the subdivision has been <br />due specifically to title problems which resulted in the need to <br />register the property through a torrens action, and not due to any <br />intended changes from the original proposal nor mere Inaction. There <br />has been one extension granted already. <br />The original preliminary plat approval Resolution #2610 was <br />adopted on March 27, 1989, Resolution #2760 was adopted February 26, <br />1990, granting an extension to March 27, 1991. Via the letter dated <br />July 23, 1991, applicant requests the effective period of preliminary <br />plat approval be extended beyond March 27, 1991 to accomodate <br />completion of the torrens action, which occurred earlier this sxxmner. <br />An extension to September 1, 1991 would be appropriate. <br />If Council was to deny the extension, this would result in the <br />need for a new preliminary plat application and another public <br />hearing. The original public hearing held on January 17, 1989 <br />generated no public interest, and Planning Commission recommended <br />•pproval on a vote of 6 to 1. On March 27, 1989, Council voted 2 to <br />1 (Peterson and Nettles-aye, Callahan-nay) to approve the subdivision <br />per the Planning Commission recommendation, with the exception that an <br />-.f: <br />M.
