Date: July 8, 2024 Item: 14 <br />Presenter: Melanie Curtis, Planner <br />Section: Consent Agenda <br /> <br />Title: #LA24-000026, 2265 and 2285 North Shore Drive, Grading IUP - <br />Resolution 7487 <br /> <br /> <br />1.Purpose: <br />The purpose of this item is to consider an Interim Use Permit (IUP) to conduct grading activities <br />over two properties in excess of 500 cubic yards in the Shoreland Overlay District. <br />2.MN§15.99 Application Deadline: <br />The application was submitted on March 24, 2024 and considered to be complete on May 20, <br />2024. The 60-day review period will expire on July 10, 2024. <br />3.Background: <br />The applicant requests an Interim Use Permit in order to utilize a maximum of 2,900 cubic yards <br />of dewatered dredging spoil materials on the two properties to create berms along North Shore <br />Drive. The remaining material will be spread thinly in the adjacent areas. <br />4.Planning Commission Vote and Comment: <br />At the July 17th meeting, the Planning Commission held a public hearing and voted 7 to 0 to <br />recommend approval of the IUP as proposed. <br />5.Public Comment: <br />Public comment was received during the meeting and consisted primarily of questions for the <br />property owner regarding the future use or development of the properties, which is not proposed. <br />6.Staff Recommendation: <br />Planning Staff recommends approval of the IUP conditioned upon compliance with the permitting <br />requirements from all applicable jurisdictions, and subject to an administrative grading permit <br />prior to commencement. <br />AGENDA ITEM <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br />COUNCIL ACTION REQUESTED <br />Council should consider a motion to approve the IUP in accordance with the approval resolution <br />attached as Exhibit A. <br />Exhibits <br />Exhibit A - Draft Resol 7487 <br />Exhibit B - Plans & Narrative <br />Exhibit C - Draft 6/17 PC Minutes <br />67
