Date: July 8, 2024 Item: 19 <br />Presenter: Melanie Curtis, Planner <br />Section: Community Development Report <br /> <br />Title: #LA24-000018, 4745 North Shore Drive, CUP - Resolution 7486 <br /> <br /> <br />1.Purpose: <br />To review a conditional use permit allowing construction of new retaining walls, lake access stairs <br />supported by walls within the bluff and 75-foot setback from the OHWL <br />2.MN§15.99 Application Deadline: <br />The application was submitted on March 20, 2024 and considered to be complete on June 10, <br />2024. The 60 day review timeline will expire on August 9, 2024. <br />3.Background: <br />The applicant, Matt Jasper, is the new owner of the property. The lakeshore slope of the subject <br />property is defined as a bluff. <br /> <br />Mr. Jasper proposes to install a new, stone lake access stair with retaining wall-supported landings <br />and a retaining wall, upslope from new rip-rap along the shoreline. The retaining walls, including <br />the walls supporting the stairs, require conditional use permit approval due to their location within <br />the bluff and 75-foot lake setback. The approvals requested to allow construction of the new 180 <br />square foot lakeside shed have been withdrawn by the applicant. <br /> <br />Please refer to the Planning Staff report for full details and analysis. <br />4.Planning Commission Vote and Comment: <br />On June 17th, the Planning Commission reviewed the application. Following a lengthy discussion, <br />the Commission voted 6 - 0 - 1 in favor of recommending denial as applied. Having arrived late, <br />Commissioner Kraemer abstained from the vote. <br /> <br />The Commission's motion including the following: <br />Walls. Support for the proposed walls. The applicant was directed to submit additional <br />documentation substantiating the need for all of the proposed walls; <br />Landscaping. The Commission directed the applicant to provide a detailed landscape plan <br />to stabilize the slope; and <br />Shed. The variances for the proposed shed/boathouse were not supported. <br /> <br />City Code allows one 20 square foot lock box (having a maximum height of 48 inches) and one <br />pump house of the same dimensions within the shore setback. An administrative zoning permit is <br />required to construct a lock box or pump house on the property. <br />5.Staff Recommendation: <br />The applicant has provided a revised site plan and updated engineering information supporting the <br />need for the walls (Exhibit B).
