'I- <br />ORONO CITY COUNCIL MEETING HELD JUNE 24, 1991 <br />ZONING ADMINISTRATOR'S REPORT: <br />(#5)ZONING FILE #1657-NICK SIMONDS <br />2007 SUGARWOOD DRIVE <br />DRIVEWAY REQUEST <br />Nick and Nanne Sinonds were present. <br />Bernhardson explained that the Simonds were requesting <br />approval to vary from the Development Standards for the Sugarwood <br />PRD. <br />Mabusth displayed a sketch of the proposed dtiveway, showing <br />that it would curve around several existing trees and encroach <br />into the 30 foot side yard setback area. <br />Bernhardson stated that the intent of the 30 foot side yard <br />setback is to assure minimal tree removal. The Simonds request <br />for encroachment into that area stems from their dc'sire to <br />preserve several large existing trees.He noted that three <br />Planning Commission members had voted to recommend approval, <br />three ’^oted to recommend denial. <br />Mr. Simonds confirmed Bernhardson's statements, adding that <br />the encroachment into the 30 foot side yard setback area would <br />have no impact on the neighboring properties. <br />Goetten stated that she had attended the June 17 Planning <br />Commission meeting when this matter was reviewed. She <br />appreciated the efforts put forth by the Planning Commission <br />pertaining to establishment of the "'evelopment ''‘tandards. <br />Goetten said, "In this case, however, ^ Simond* a'->:-Tying to <br />preserve trees, which is ^he basis of *'le development <br />Standards. I cannot see w.’’. we would not allow this to occur. I <br />did go out to the Simond house and I could see that a large <br />Maple tree, among others, would have to come down if the <br />Development Standards are met." <br />Jabbour, Mayor Peterson, and Butler indicated that they <br />concur with Goetten that tree preservation is an important aspect <br />of not only the Sugarwood Development, but the entire Community <br />as well. <br />It was moved by Goetten, seconded by Mayor Peterson, to <br />approve a Variance to the Sugarwood Development Standards, by <br />allowing the driveway at 2007 Sugarwood Drive to encroach into <br />the 30 foot side yard setback in order to preserve several mature <br />trees. All voted aye. Motion passed. <br />Mr. Sid Rebers, owner of property adjacent to the Simonds, <br />expressed his appreciation for Council's approval and confirmed <br />that the proposed location of the Simonds' driveway v;ould in no <br />way impact bis property. <br />-3 -
