Briefly, the <br />applicant requests a hardcover variance of 1.2% (518 s.f.) to <br />construct two decks in the 75-250' zone. <br />The memo of June 13 describes the recent history leading to <br />this request, and notes that prior to the remodeling project that <br />is nearing completion, 75-250* hardcover was about 30%. Final <br />proposed 75-250* hardcover is 26.2%. <br />Planning rn—ission Re dation <br />At their June meeting. Planning Commission voted 5 to 1 to <br />reconunend approval of the variance as requested, finding that due <br />to the unique circumstances noted in the memo, the applicant is <br />now in a position of either having to remove more square footage <br />from an already minimal driveway, or remove an extensive sidewalk <br />system constructed prior to applicant's apparent knowledge of theV'Was V - - - -- r e <br />hardcover limitations for this property. Further, Planning_ » _ _J _ ofCooimisslon members suggested that because approximately half o <br />the lot in the 0-75’ zone has less than 1% hardcover, the <br />property generally meets the intent if not the letter of the <br />hardcover ordinance. <br />In a minority opinion. Planning Commissioner Cohen felt that <br />there is no legitimate hardship.
