We would be willing to cooperate in drafting and executing a mutually <br />agreeable restrictive covenant referring to Lot 1, Block 1, MacMILLAN ADDITION, <br />locating the site of the demolished building thereon, and providing that any new <br />construction on the site of the demolished building would not be able to proceed <br />without first contacting the building department of the City of Orono, or other <br />governmental entity then having jurisdiction, to give that governmental entity the <br />opportunity to review the contractor’s plans for site excavation, to monitor the <br />excavation vrork, to examine the condition of the fill exposed, and to then require <br />the removal of any fill on the site, and/ or any remainiiig basement slab, which has <br />been exposed by the excavation for the new construction, then determined to be not <br />in compliance with the then existing clean fill or demolition requirements of the <br />governmental entity. <br />Very Truly Yours, <br />THE WAKEFIELD ORONO <br />PARTNERSHIP <br />f.
