L <br />I <br />1. <br />- <br />•r L <br />f;-' <br />b:i <br />sI <br />f-'. <br />f*: <br />Whitney MacMillan, 1620 Fox Street - <br />June 20, 1991 <br />Page 2 of 2 <br />I will not repeat the position of staff on this matter as <br />the Building Official's memo (Exhibit C) reviews them in full. <br />We certainly appreciate and understand the dilemma created for <br />the property owner, but our recent amendment regarding clean fill <br />was passed because we wished to eliminate just such a problem. <br />He know of no other city that would not require demolition <br />permits for the removal of principal structures. Remember that a <br />burning permit is not a demolition permit. <br />Mr. MacMillan asks for special consideration and the waiving <br />of the requirement of the demolition permit. Staff would <br />reconmend that the Council would approve obtaining the demolition <br />permit. Mr. MacMillan proposes the filing of a covenant on the <br />property consistent with the P.C.A. standards for residential <br />demolition debris/land disposals. <br />Optioam <br />1.Denial of applicant's request to wai'»e requirements of <br />Section 10.03, Subdivision 19 (clean fill) and to require <br />applicant's contractor obtain a demolition permit for the <br />removal of the structure on Lot 1, Block 1, MacMillan <br />Addition (1620 Pox Street), requiring the removal of the <br />foundation debris and the immediate filling with clean fill <br />and seeding of the area so that ground covo ’* can b« <br />restored; or <br />2.Approve applicant's request to waive requirements of Section <br />10.03, Subdivision 19 as it relates to demolition permits <br />subject to the following conditions: <br />A) Applicant's contractor to file for demolition <br />permit for removal of residence (1620 Fox Street). <br />B) Applicant to provide a covenant defining the <br />unauthorized disposal site providing a survey/site plan <br />locating the disposal site with the understanding that <br />at some time in the future if construction is to take <br />place near or within the disposal area, that owner will <br />agree to remove any fill that does not meet the current <br />dec fill standards of the Ci . <br />C) This covenant should be presented to the City in a <br />form suitable for filing.
