Date: June 17, 2024 Item: 5.1 <br />Presenter: Melanie Curtis, Planner <br />Section: Public Hearings <br /> <br />Title: #LA24-000018, Matt Jasper, 4745 North Shore Drive - CUP, Variances <br />(Staff: Melanie Curtis) <br /> <br /> <br />1.Purpose: <br />To review a conditional use permit and variances to construct new retaining walls, lake access stairs <br />supported by walls, and a new ~15’ x 12’ lakeside shed less than 5 feet from the OHWL and within the <br />average lakeshore setback, 75-foot structure setback from the OHWL, within the bluff and bluff impact zone, <br />and hardcover within the 75-foot setback from the OHWL. <br />2.MN§15.99 Application Deadline: <br />The application was submitted on March 20, 2024 and considered to be complete on June 10, <br />2024. Therefore the 60 day review timeline will expire on August 9, 2024. <br />3.Background: <br /> The applicant proposes to install a new stone lake access stair with retaining wall-supported <br />landings, a new lakeside shed, and a retaining wall upslope from the new rip-rap on the eastern <br />portion of the shoreline. The shed requires average lakeshore and 75-foot OHWL setback <br />variances, and a hardcover variance within the 75-foot setback; the retaining walls require <br />conditional use permit approval. The applicant has a permit from the MCWD for shoreline <br />stabilization including rip-rap. <br />4.Staff Recommendation: <br />Staff recommends denial of the variances for the shed as proposed, denial of the set-in-grade stone <br />staircase with walls in the bluff. Staff further recommends tabling the CUP application for new <br />retaining walls to allow the applicant to provide the additional information requested to include <br />updated engineering and a landscape plan. <br />5.Planning Commission Action Requested: <br />The Planning Commission should consider the following options for a motion: <br /> <br />1. Deny the application as applied. The practical difficulty standards have not been met to <br />support granting the variance request, The application is missing information in order to <br />comply with the conditional use permit standards; or <br />2. (Recommended by Staff) Move to table the application and direct the applicant to provide <br />the requested information for Planning Commission review on the July agenda; or <br />3. Offer a split recommendation, if the Commission is generally comfortable with the proposal, <br />move to approve the CUP with conditions and direct the applicant to provide the requested <br />information AND deny the variance request for new 165-square-foot shed so the CUP <br />application can proceed to a City Council agenda for consideration. <br />4. Approve both the CUP and Variance request.
