<br />#10634702v3 <br /> <br />8 <br />reasonable periods of time before and after collection, all trash and refuse containers shall <br />be stored in the Owner’s garage or screened so they cannot be seen from any street. <br /> <br />4.8 Signs. No advertising sign of any kind shall be displayed in public view on any <br />Homesite except one sign of not more than six (6) square feet advertising a Homesite for <br />sale or signs used by a builder to advertise during active construction or sale. Signs <br />expressing support for a political candidate, a political affiliation or commonly associated <br />with a political ideology may be displayed for a period of 60 days prior to the applicable <br />election and shall be removed promptly following the election. <br /> <br />4.9 Nuisance. No trade or activity shall be conducted upon any Homesite or Common Area <br />in the Property that may be or may become an annoyance or nuisance to any property <br />within the Property. Examples include home occupations, trades or activities that violate <br />any municipal codes or ordinances or state or federal laws, cause waste to the Property, <br />or cause any unusual liability, health or safety risk, or expense for any Owner. <br />Declarant’s development, sales or construction activities or operations within the <br />Property do not violate this paragraph. <br />4.10 Tree Preservation Area. To protect the scenic attractiveness of the Property, and to <br />preserve significant existing trees and site-line buffers within the Property, Declarant <br />hereby creates the “Tree Preservation Area” identified on Lot 5 as shown on Exhibit “B” <br />attached hereto and hereby incorporated by this reference. Within the Tree Preservation <br />Areas no person shall (i) construct, install or maintain any device, structure, equipment <br />other item within the dripline of a tree that has the potential to damage the tree; or (ii) cut <br />or remove trees; or (iii) excavate or fill when such activities may contribute to damage or <br />loss of protected trees. The foregoing restrictions do not apply to removal of dead or <br />diseased trees as determined by a professional, licensed arborist, or trimming of trees to <br />maintain health. No amendment to the Tree Preservation Areas shall be allowed without <br />the prior written approval of the City of Orono. <br /> <br />4.11 Rights of Declarant and Homebuilders. Until the last Homesite is sold and conveyed <br />to an Owner other than the Declarant or a builder whose business is to construct homes <br />for resale, the following action by said persons, and their agents and assigns, will not be <br />deemed violations of the foregoing restrictions: <br /> <br />a. Use of a Dwelling for model and sales office purposes; <br /> <br />b. Storage of equipment, materials or earth during the construction of new <br />Dwellings on Homesites owned by the person doing such storage or construction; <br />and <br /> <br />Display of signs advertising Homesites in the Property as allowed by the City. <br /> <br /> <br />SECTION 5 <br />ASSOCIATION MEMBERSHIP: RIGHTS AND OBLIGATIONS <br /> <br />346
