<br />#10634702v3 <br /> <br />4 <br /> <br />1.22 “Person” shall mean a natural individual, corporation, limited liability company, <br />partnership, trustee, other or legal entity capable of holding title to real property. <br /> <br />1.23 “Plat” shall mean the plat of Honey Hill on Lake Classen, recorded in the offices of the <br />County Recorder and/or Registrar of Titles, Hennepin County, Minnesota, and any <br />amendments or supplements thereto, and replats thereof. <br /> <br />1.24 “Property” shall mean all of the real property submitted to this Declaration, including <br />the Homesites, Common Areas and all structures and improvements located thereon now <br />or in the future. The initial Property as of the date of this Declaration is legally described <br />in Exhibit “A”, attached hereto. <br /> <br />1.25 “Rules and Regulations” shall mean the Rules and Regulations of the Association as <br />approved from time to time pursuant to Section 7.6. <br /> <br />1.26 “Shared Roadway” shall mean that certain private roadway serving Honey Hill and <br />platted as Outlot A as shown on the Plat. The Shared Roadway shall be Common Area <br />owned by the Association. <br /> <br />1.27 “Special Assessment” shall mean and refer to an assessment levied against the <br />Homesites in accordance with Section 6.3 of this Declaration. <br /> <br />1.28 “Special Declarant Rights” means rights reserved in the Declaration for the benefit of a <br />Declarant to: (i) complete improvements indicated on the Plat; (ii) subdivide Homesites <br />or convert Homesites into Common Areas and/or Homesites; (iii) maintain sales offices, <br />management offices, signs advertising the Property, and model homes; (iv) use easements <br />through the Property for the purpose of making improvements within the Property; (v) <br />appoint or remove any officer or director of the Association where applicable, during any <br />period of Declarant control; or (vi) any other rights as set forth in Section 14 or other <br />provisions of this Declaration reserved for the benefit of Declarant. <br /> <br />SECTION 2 <br />DESCRIPTION OF HOMESITES AND APPURTENANCES <br /> <br />2.1 Homesites. There are six (6) Homesites comprising the intitial Homesites of the <br />Property, and all Homesites shall be restricted exclusively to residential and allowable <br />home office use as defined by code in the City of Orono. Each Homesite constitutes a <br />separate parcel of real estate. No additional Homesites may be created by the subdivision <br />or conversion of Homesites, except as allowed in Section 15, below, or as otherwise <br />allowed by code as it relates to Accessory Dwelling Units within the same property. The <br />Homesite identifiers and locations of the initial Homesites are as shown on the Plat, <br />which is incorporated herein by reference, and a schedule of Homesites is set forth on <br />Exhibit “A”. The Homesite identifier for a Homesite shall be its lot and block numbers <br />and the subdivision name, and any additional Homesites made subject to this Declaration <br />will be as set forth in any Supplemental Declaration as defined in Section 14. <br /> <br />342
