<br />#10634702v3 <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br />_____________________________________________________________________ <br />[Above space reserved for recording information] <br />DECLARATION OF COVENANTS, CONDITIONS, AND RESTRICTIONS <br /> <br />FOR <br /> <br />HONEY HILL ON LAKE CLASSEN <br /> <br /> THIS DECLARATION OF COVENANTS, CONDITIONS, AND RESTRICTIONS (this <br />“Declaration”) is made in the County of Hennepin, State of Minnesota, on this ____ day of <br />_______________, 2024, by Aspect Design Build L.L.C., a Minnesota limited liability company (the <br />“Declarant”). <br /> <br /> WHEREAS, Declarant is the owner of certain real property located in Hennepin County, <br />Minnesota, legally described in Exhibit “A” attached hereto, and <br /> <br /> WHEREAS, Declarant desires to establish on the Property (as defined below) a plan for a <br />permanent residential community, commonly known as Honey Hill on Lake Classen (“Honey Hill”), to <br />be owned, occupied and operated for the use, health, safety and welfare of its resident Owners and <br />Occupants, and for the purpose of preserving the value, the structural quality, and the original <br />architectural and aesthetic character of the Property, and <br /> <br /> WHEREAS, Honey Hill is not subject to the Minnesota Common Interest Ownership Act <br />(“MCIOA”), Chapter 515B of the Minnesota Statutes. Honey Hill is exempt from MCIOA pursuant to <br />Minn. Stat. §515B.1-102(e)(2), because the Homesites consist solely of separate parcels of real estate <br />designed or utilized for detached single family dwellings, and the Association has no obligation to <br />maintain any building containing a dwelling or any agricultural building, and the Declarant has not <br />elected to subject the Property to MCIOA, and references to MCIOA herein or any reliance on terms or <br />provisions defined or specified in MCIOA are for convenience only. <br /> <br /> THEREFORE, Declarant hereby declares that this Declaration shall constitute covenants to run <br />with the Property described herein, and that the Property shall be owned, used, occupied and conveyed <br />subject to the covenants, restrictions, easements, charges and liens set forth herein, which are for the <br />purpose of protecting the value and desirability of and shall run with the Property, and shall be binding <br />upon all persons owning or acquiring any right, title or interest in the Property, and their heirs, personal <br />representatives, successors and assigns, and shall inure to the benefit of each owner thereof. <br /> <br />SECTION 1 <br />339
