PRACTICAL DIFFICULTIES DOCUMENTATION FORM <br />LA24-000029 <br />1. The property owner proposes to use the property in a reasonable manner not permitted <br />by the Zoning Chapter. <br />Response: Although the proposed front elevation change is not in compliance to the setback <br />requirements, it is only due to the fact that the house was built with approximately 70% of the <br />footprint inside the 75’ setback. The entryway change DOES NOT protrude closer to the shoreline that <br />the existing house does. <br />2. The plight of the landowner is due to circumstances unique to his property not created <br />by the landowner. <br />Response: The plight of the landowner is due to the fact that the house was permitted to be located <br />with-in the 75’ setback. If the original structure was built outside of the setback no variance would be <br />necessary. <br />3. The variance, if granted, will not alter the essential character of the locality. <br />Response: The small addition will blend seamlessly with the existing home and is an improvement in <br />aesthetics to the general public and adjacent neighbors <br />4. Economic considerations alone do not constitute practical difficulties if reasonable use <br />for the property exists under the terms of the Zoning Chapter. <br />Response: The requested variance is not due to economic reasons. The new homeowners seek to <br />improve the front elevation of the home as part of a total renovation of the main level of the home. <br />This improvement requires a small addition that does not encroach beyond the current encroachment <br />into the setback. The variance is only necessary due to the original home’s construction by previous <br />owners inside the 75’ setback. <br />5. Practical difficulties include, but are not limited to, inadequate access to direct sunlight <br />for solar energy systems. Variances shall be granted for earth-sheltered construction as <br />defined in Minnesota Statutes, Section 116J.06, Subd. 2, when in harmony with this <br />Chapter. <br />Response: n/a <br />6. The Board of Appeals and Adjustments or the Council may not permit as a variance any <br />use that is not allowed under this Chapter for property in the zone where the affected <br />person's land is located. <br />Response: The requested variance is expanding a single family dwelling which is in compliance with <br />this Chapter for property in this zone. <br />7.
