A RBSOLDTION GRANTING <br />VARIAHCSS TO <br />MUNICIPAL X0NIN6 CODE <br />SECTION 10.03, SUBDIVISION 9 (D) AND <br />SECTION 10.28, SUBDIVISION 5 (B) <br />FILE #1639 <br />WHEREAS, Eleanor L. Ferril (hereinafter "the <br />applicant”) is the owner of the property located at 240 Wakefield <br />Road within the City of Orono (hereinafter "City") and legally <br />described as follows: <br />Lot 2, Bloc)c i, Wa)cefield Farms Second Addition, Hennepin <br />County, Minnesota (hereinafter "the property"); and <br />WHEREAS, the applicant has applied to the City for a <br />variance to Municipal Zoning Code Section 10.03, Subdivision 9 <br />(D) to allow an accessory building nearer the front or street lot <br />line than the principal building on the property; and a variance <br />to Section 10.28, Subdivision 5 (B) to permit construction of an <br />above^grade encroachment-type deck attached to the house and <br />located 22* from the side lot line where a 30' side lot line <br />setback is normally required. <br />HOW, THEREFORE, BE IT RESOLVED by the City Council of <br />Orono, Minnesota: <br />FINDINGS <br />1. This application was reviewed as Zoning Pile #1639. <br />2. The property is located in the RR-IB Single Feunlly Rural <br />Residential Zoning District. <br />3. The Orono Planning Commission reviewed this application <br />on May 20, 1991, and unanimously recommended approval of the <br />proposed variances based on the following findings: <br />A) Because the house is located more than 250* from <br />Wakefield Road« and because there is much vegetative <br />screening between the street and house, the greenhouse <br />will not appear as a front yard encroachment as viewed <br />from the street. <br />Page 1 of 4 <br />, >4y i#^.a
