SHORE PROTECTION <br />BY THE MINNESOTA DEPARTMENT OF NATURAL RZSOURC'£S <br />tl:r <br />•f <br />PERMIT REQUIREMENTS AND CONSTRUCTION GUIDELINES <br />Under Minnesota Statutes, Chapter 105, public waters <br />are any waters of the state which serve one or more mate <br />rial beneficial public purposes including navigation, <br />recreation, fish and wildlife habitat, nutrient and sedi- <br />^ent entrapment, water supply, ground water recharge, <br />floodwater retention, and scientific and natural areas. <br />Any projected constructed below the ordinary high water <br />mark (OHW) which alters the course, current, or cross- <br />section of public waters is subject to the regulatory ju <br />risdiction of the Department of Natural Resources. For <br />lakes, the OHW is the highest elevation which the lake <br />has maintained to leave evidence upon the landscape. for <br />watercourses, the OHW is the elevation of the top of the <br />bank of the channel. For reservoirs and flowages, the <br />OHW is the operating elevation of the normal summer pool. <br />A permit is not reu. red from the Department of Natural <br />Resources for ripr-iV shore protection installed within <br />the following restrictions. Local units of government <br />and other agencies, however, may still require a permit <br />for this project. Before initiating any project, contact <br />your local conservation officer or the Regional Hydrolo <br />gist. <br />A Department of Natural Resources permit is not re <br />quired if the riprap shore protection is installed within <br />all of the restrictions listed below; <br />1. The riprap shore protection snail consist of nat <br />ural rock only. <br />2. The riprap shore protection shall conform to the <br />natural alignment of the shore. <br />3. The minimum finished slope shall be no steeper <br />than 3 feet horizontal to 1 foot vertical (3:1). <br />4. No materials shall be placed more than 5 feet wa- <br />terward of the OHW.
