The current road is under the jurisdicition of both <br />Minnetonka Beach and Orono. The City of Minnetonka Beach <br />will maintain the road at its present rural design. It <br />would be incongruous and poor des..n practice for the City <br />of Orono to require an urban section for the portion of the <br />road within Orono. <br />■OWr THBRBFORB BB IT RBSOLVBD, tnat based upon either <br />one or more of the findings noted above, the City Council of the <br />City of Orono hereby approves the preliminary plat application of <br />E.M. Blanch, Jr. for the property located at 2501 Old <br />per the survey dated May 25, 1990, revised October 2, 1990 by <br />William R. Engelhart and a variance to Section 11.33, Subdivision <br />4 "Public Streets/Residential" that would allow the existing <br />section of roadway to remain rather than the required urban <br />section at a 32 feet minimum width with curbing, subject to the <br />following conditions: <br />1, Prior to the issuance of building permits for new <br />construction, the applicant shall be responsible for <br />extending sewer and water lines and payment to the City for <br />the cost of a 1 1/2 inch bituminous overlay over portions of <br />Old Beach road located within the City of Orono. The <br />applicant shall pay 50 per cent of the total cost of the <br />bituminous overlay prior to final plat approval. If sewer <br />and water improvements are not completed prior to final plat <br />approval, applicant shall execute a developer's agreement <br />and post appropriate security in the form of a Letter of <br />Credit to assure that these improvements are completed. <br />2« Outlet A has fc n created for the purpose of creating <br />special protection for the sensitive wetland areas within <br />the City of Orono. The City of Orono to acquire special <br />open space and flowage easements over the outlet (see sample <br />easements enclosed). Applicant has agreed to also execute <br />private covenants for the protection of the area and shall <br />provide copies of these covenants for the City's review. <br />3. Lot 8 has been created for the future use of the Fresh <br />Water Foundation to be developed by either the Foundation or | <br />to be transferred to the University of Minnesota. , <br />future uses of Lot 8 shall be consistent with current B~4 j <br />zoning.
