Note in Exhibit B that the original <br />preliminary plat showed the property designated as an outlot, <br />suggesting the lot was to be combined with che adjacent lands owned by <br />the University. Lot 6 conforms to all standards of the B-4 code with <br />a total lot area of approximately 2.75 acres and dry buildable <br />envelope at 1.4 acres. <br />When originally presented by the applicant or applicant's <br />representatives, it was staff's understanding that the Freshwater <br />Biological Institute would acquire the property for further expansion. <br />As Nr. Jessen's letter notes. Exhibit C, the Freshwater Foundation <br />does not plan to convey Lot 8 to the University of Minnesota for any <br />expansion or use by the Freshwater Biological Institute. The <br />applicant's attorney has asked that Condition 1 of that resolution be <br />amended to allow Lot 8 to be sold and used by any third party as long <br />as that use was consistent with the current B-*4 zoning. <br />The enclosed resolution has been drafted for review and <br />action by the Orono Council. <br />Isv
