Note in Exhibit B that the original
preliminary plat showed the property designated as an outlot,
suggesting the lot was to be combined with che adjacent lands owned by
the University. Lot 6 conforms to all standards of the B-4 code with
a total lot area of approximately 2.75 acres and dry buildable
envelope at 1.4 acres.
When originally presented by the applicant or applicant's
representatives, it was staff's understanding that the Freshwater
Biological Institute would acquire the property for further expansion.
As Nr. Jessen's letter notes. Exhibit C, the Freshwater Foundation
does not plan to convey Lot 8 to the University of Minnesota for any
expansion or use by the Freshwater Biological Institute. The
applicant's attorney has asked that Condition 1 of that resolution be
amended to allow Lot 8 to be sold and used by any third party as long
as that use was consistent with the current B-*4 zoning.
The enclosed resolution has been drafted for review and
action by the Orono Council.
Isv
