Bernhardson, City Administratol^'''^ <br />May 17, 1991 <br />SUBJECT: Liquor Violation Review Process <br />Attachment: A, Liquor .iolation Review Process Memo Dated <br />5/8/91 <br />ISSUE - Establishment of a review process for liquor license <br />violations. <br />INTRODUCTION - Attachment A was presented at your May 13, 1991 <br />Council meeting but was tabled at staff request until your May <br />28# 1991 meeting. <br />DISUCSSION - After further review of the process by the attorney# <br />Ke indica ted that the process proposed in Attachment A is <br />preferable from a legal standpoint to the "model" that we have <br />used# having the Council both "judge and jury". <br />ALTERNATIVES <br />1. Continue with the current process. <br />2. Adopt the proposed process. <br />3* Amend and adopt. <br />4. Table for further discussion. <br />RECOMMENDATION - It is recommended that the new process be <br />adopted as presented and that it be formalized or that Council <br />review such matters. <br />PROPOSED MOTION - Moved by _# seconded by _# that Council <br />direct staff to present a formal procedure at the Council's next <br />mc^eting incorporating the new procedure.
