Gilbert <br />Meshbesher & Spence, Ltd. <br />1616 Park Avenue <br />Minneapolis, MN 55404 <br />RE 1960 Shoreline Drive <br />Dear Mr. Gilbert: <br />The City Council has asked me to inform you that it will <br />determine whether to reconsider the issuance of the amended <br />Conditional Use Permit to Mr. Toberman for the property at 1960 <br />Shoreline. The interest in reconsideration comes from .wo <br />attached recent Court of Appeals cases, one interpreting the <br />City of Minneapolis Conditional Use Permit and the other <br />interpreting Minn. Stat. 394.36, subd. 1 and an Isanti County <br />Zoning Ordinance with respect to discontinuance of <br />non-conforming uses. <br />Mr. Alan Nettles, a neighboring property owner, has <br />challenged the legality of the City’s amended use permit in this <br />case. I attach his leuter to the City Administrator. <br />The Council has asked me to provide my own opinion to <br />them on the legality of its recent decision. I would appreciate <br />your comments on these cases before I do so.
